ASAP MOTORS & PARTS SYSTEMS, INC.-LIMITED WARRANTY FOR USED ENGINE

THIS LIMITED WARRANTY issued by ASAP Motors & Parts Systems, Inc. warranties that used engines are warranted to be free of any internal defects in material or workmanship. Repair or replacement of a defective engine will be provided under normal use and proper maintenance requirements set forth by the manufacturer, subject to the following terms and conditions.

1. Definition
Used Engine: Sold as Long Block only, identical replacement unit, tested and steam cleaned engine with water pump, distributor, manifolds, carburetor, flywheel, brackets, oil pressure and water temperature, sending units, and/or any other add-on accessories. These add-on accessories (mentioned above) are complimentary and are left on the engine for the buyer’s convenience only. It is the buyer’s responsibility to change over such accessories and emission control devices as necessary to comply with federal law administered by the Environmental Protection Agency. The Clean Air Act (42 U.S.C. 1957 et seq.) restricts removal or modification of any part of an emission control system required for a motor vehicle designed for transporting persons or property on any public street or highway. Applicable state laws vary from state to state. Add-on accessories are specifically excluded from any warranty offered herein.

2. Term:
(a) Standard Warranty: 3 months or unlimited miles.
(b) Non-transferable Warranty. Valid only to the original owner, warranty terminates upon sale of vehicle.

3. Repair or Replacement:
ASAP Motors, at its sole discretion, has the option to repair the engine or replace it with similar product. In case of mechanical defect, the buyer must notify ASAP Motors & Parts Systems, Inc. for instructions and authorization prior to making any repairs or replacements. Cost of parts will be reimbursed or parts will be supplied at our cost. However, if any repair exceeds twenty-five percent of the total value of the unit, the defective engine must be returned as sold completely assembled with all add-on accessories attached. ASAP Motors & Parts Systems, Inc. will replace it with a good identical unit.

4. Refund:
All monetary claims must be made in writing, stating the reason. Good items returned are subject to a 20% restocking charge.

5. Standard:
ASAP Motors & Parts Systems, Inc. shall, at its option, repair or replace the defective engine within the warranty term without charge to the buyer subject to the limitations listed herein:

6. Limitations:
The warranty is voided by:
1. Misuse, negligence, alterations, accidents, or fire.
2. Improper installation or repair.
3. Use of the engine in commercial vehicles or competitive events.
4. Failure to follow the recommended maintenance requirements.
5. Lack of lubrication and/or overheating.The following are at the expense and obligation of the buyer.
6. Any repair or replacement not authorized by ASAP Motors & Parts Systems, Inc.
7. Sale, installation use or operation without the original emission control equipment.
8. Missing, removed or melted heat tabs.

The Following are at the expense and obligation of the buyer:

1. Service adjustment, ignition, timing, tune-up; brake and clutch adjustments.
2. Maintenance services, lubrication, and fluids.
3. Replacement of service items such as spark plugs, ignition points, gaskets, timing belts and filters. Parts or labor to increase cooling efficiency, without limitation.
4. Engine ignition electrical fuel systems without limitation.
5. Engine cooling system servicing and replacement of fan belts, hoses, coolant, or any
6. Adjustment to valves if necessary.
7. Modifying or Rendering inoperative any Emission Control Device, Or Any Act That Contributes to the Violation of EPA Requirements, Voids This Warranty.

8. LIMITED LIABILITY
1. ASAP Motors & Parts Systems, Inc. liability under this warranty is solely limited to the repair or replacement of defective used engines. The labor required to repair an engine and/or remove it from a
vehicle, and any other expenses relating to turn-over and other incidental charges for a defective unit are not reimbursable.
2. ASAP Motors & Parts Systems, Inc., shall not be liable for any consequential, incidental, or special damages, or for any services not expressly provided herein relating to or arising from used engines
sold by ASAP Motors & Parts Systems, Inc.

9. LIMITED WARRANTY
This Warranty is in lieu of all other express warranties of ASAP Motors & Parts Systems, Inc. Any implied warranty is limited in duration of this written warranty. ASAP Motors & Parts Systems, Inc. does
not assume or authorize any distributor, dealer, agent or employee to enlarge or extend this warranty, or to assume any other obligations on its behalf.

1. This warranty does not apply to rotary engines or high performance engines designed or used for competition purposes.

LIMITED WARRANTY, TERMS AND CONDITIONS:
USED AND RECONDITIONED ENGINES - 6 months or unlimited miles. Warranty covers replacement or repair of the engine only and does not cover labor and any other incidental expenses required to repair an engine and/or remove it from a vehicle. Sold as long block only. The buyer agrees to transfer all other smog equipment including intake and exhaust manifolds, fuel injection systems, and electronic controls system from the original engine to the second-hand replacement engine. 30 days warranty on head gasket, but does not cover for blown head gasket or overheating. No warranty on timing belt. If the crankshaft shaft,main caps, bearing caps or head are removed without express written permission the warranty is void.
USED TRANSMISSIONS are warranted for a period of 6 months from the date received. Warranty covers replacement or repair of the transmission component only and does not cover labor costs
associated with those replacements or repair. If the transmission is dismantled this warranty is void.

IMPORTANT: 1. Should be installed, maintained, or adjusted by a qualified technician. 2. Set ignition to specification as recommended by mft. 3. Change oil after the first 500 miles. 4. Retorque
cylinder head bolts to mft’s specifications, ignition off, operating temperature. 5. Check cooling system. Service if rusted or contaminated with oil; replace coolant.

Racing engines not legal for use on any public street or highway in California. Off-road use only.
Title to goods does not pass to buyer until funds are collected and/or cashed by ASAP Motors & Parts Systems, Inc. Returned checks will be charged $25.00 each. All cost of collection will be charged
to buyer. 1-1/2% per month (18% per annum) Service Charge, will be applied to Past Due Accounts.

THE LEGAL RIGHTS AND OBLIGATIONS OF THE PARTIES SHALL BE INTERPRETED UNDER TEXAS LAW IN THIS WARRANTY.

There are no oral agreements or representations that accompany this transaction. This limited warranty contains the entire agreement of the parties. The front or back page cannot be modified except in writing.

Entire Agreement This Agreement contains the entire agreement between the parties in respect to the matters herein set forth, supersedes all prior agreements between the parties with respect thereto, and may not be modified, amended or altered except in writing signed by both parties.

No waiver No waiver by either party of any breach by the other of any provision of this Agreement shall be deemed or construed to be a waiver of any subsequent or continuing breach of the same or any other provision of this Agreement; nor shall any forbearance by either party from the exercise of a remedy for any breach be deemed or construed to be a waiver by such party of any of its right or remedies with respect to such breach.

Successors and Assigns This Agreement warranties contained herein and all of the terms and provisions hereof may not be sold or assigned to any third parties.

Legal Construction The provisions of this agreement are not intended to be severable, in case any one or more of the provisions contained in this Agreement shall for any reason be held to be invalid, illegal, or unenforceable in: any respect, such invalidity, illegality, or unenforceability shall not affect any other provision hereof, and this Agreement in such manner as to give the maximum effect to such invalid, illegal, or unenforceable provision and the intention of the parties.
